To consider passing the following resolution:

“That under Section 100(A)(4) of the Local Government Act 1972, the press and the public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 3 and 4 of Schedule 12A to the Act”.

RESOLVED that under Section 100(A)(4) of the Local Government Act 1972 the press and public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 3 of Part 1 of Schedule 12A to the Act.

Report of Executive Director Strategy & Governance & Monitoring Officer, Maxine O’Mahony

The Investigation Officer presented her report by telephone and added no further comment to the report that had already been submitted.

The Panel heard from the Complainant and the Chairman invited the Panel to ask her questions.

The Subject Member was not present and had not presented any additional comments to those in his response to the complaint or the investigation report.

The Independent person was invited to present her views of the complaint.

The Panel retired to consider their findings which are set out in the Decision Notice attached.  In doing so, the Panel had regard to the evidence given in person by the complainant, the views of the Independent Person, and all of the information in the agenda pack – which included the subject Member’s written response to the complaint.
