Exclusion of Press and Public

To consider passing the following resolution.

 

“That under Section 100 (A) (4) of the Local Government Act 1972, the press and the public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraphs 1 and 2 of Schedule 12A to the Act.”

Resolved that under Section 100 (A) (14) of the Local Government Act 1972, the press and public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 1 and 2 of schedule 12A to the Act.

Application for the grant of a Hackney Carriage / Private Hire drivers licence

Minutes:

The Chairman introduced the Panel members and officers in attendance and explained the procedures.

 

The Licensing Officer presented the report in respect of an application for a Hackney Carriage/Private Hire driver licence, that application having disclosed certain information which required this to be referred to the Panel.

 

The Applicant gave an explanation of the circumstances surrounding the various matters referred to and the members asked the applicant questions.

 

The Applicant and the Licensing Officers left the room whilst the panel made their determination. They were invited back to hear the decision.

 

The Committee confirmed that they must consider each case on its own merits and took into account a number of factors. The Applicant must be a fit and proper person to hold the licence. The Applicant must be a person of trust, the principle consideration is whether or not the property or wellbeing of the public may be at risk. Public safety is the paramount consideration.

 

The Panel considered the unspent conviction from 2016 and heard the circumstances surrounding that. The Panel also considered the Applicants history. Finally the Panel took into account the fact the Applicant was to be employed by a reputable Taxi Company and therefore considered that the Applicant was a fit and proper person and the Licence was granted.

 

 

 

RESOLVED that:

 

having regard to all the information presented the application for the grant of a Hackney Carriage/Private Hire Drivers Licence in accordance with the Local Government (miscellaneous provisions) Act 1976, the Town and Police Clauses Act 1847 and the current Breckland Council Taxi policy be approved.
