The Chairman confirmed that the Panel consisted of the same Members as the previous adjourned hearing. The procedures were explained.

Exclusion of Press and Public (Agenda item 4)

Minutes:

RESOLVED that under Section 100(A) of the Local Government Act 1972 the press and public be excluded from the meeting for the following item of business on the grounds that it involves the disclosure of exempt information as defined in paragraph 3 of Part 1 of Schedule 12A to the Act.

Application for the renewal and / or suspension of a Hackney Carriage / Private Hire drivers licence (Agenda item 5)

TB presented the report.

 

This Hearing had been previously adjourned awaiting further information.

 

The Chairman queried the contract being “driver specific”. The information received from Norfolk County Council indicated that the contract was with the Company and not with an individual driver.

 

The License Holders’ Manager confirmed that if the Licence Holder was suspended he would be replaced and would therefore have no work for him.

 

The Chairman queried what happened to the Licence Holder during the school summer holidays when the contract was not active and if the Licence Holder was absent through sickness.

 

The Licence Holders’ Manager confirmed that during the school holidays he would be given other jobs. If absent through sickness the Licence Holders’ Manager’s wife would stand in to cover the contract.

 

The Licence Holder advised the school contract he is responsible for was of a delicate nature and it would suffer if a new driver was brought in.

 

The Licence Holder with his Manager, and the Licensing Officer left the room whilst the Panel made its determination.  They were then invited back to hear the decision.

 

The Chairman advised that the Committee had considered all the circumstances and it was:

 

RESOLVED that the application to renew the Licence be granted; subject to the Licence Holder being suspended for a period of 2 weeks.

 

The Panel was concerned with the difficulties the Licence Holder had with reading. It was requested that any future paperwork be sent on coloured paper and emailed to him. A copy of the Licensing Conditions was also requested by the Panel to be sent to the Licence Holder on coloured paper.

 

The Chairman explained the appeal process.
