That having considered all the oral and written evidence submitted and having given consideration to the Licensing Act 2003 and its regulations, the national guidance and the Council’s licensing policy, the Sub-Committee makes the following findings of fact:
The police have been called on a number of occasions
in the recent past to incidents both within and in the immediate
vicinity of the Plough & Furrow.
There is evidence of a lack of proper management of
the premises over a period of time.
There was evidence of a previous lack of control by
door staff employed at the premises.
We note that the licence holder is now in a position
to exercise greater control over the management of the
5. We also note that the licence holder has expressed a desire to maintain the improvements to the management of the premises in the future.
However, in the circumstances, we consider that the application for Variation dated 23rd October 2009 be refused.
Reason for Decision
The sub-committee needs to be satisfied that improvements promised by the applicant be maintained in promoting the licensing objective of preventing crime and disorder.
The decision was announced by the Chairman and copies of the decision notice were distributed at the close of the meeting.
