“That under Section 100(A)(4) of the Local Government Act 1972, the press and the public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraphs 1 and 3 of Schedule 12A to the Act”.

Applications for the Transfer and Vary DPS of a premises licence (Continued) Minutes: The hearing was conducted in accordance with the procedure as set out in the agenda.
Decision: In order to promote the Licensing objective of Crime and Disorder, the decision was taken to reject the applications to transfer the premises licence and vary the Designated Premises Supervisor (DPS) for licence PL1112 Mini Market (Thetford), 11 White Hart Street, Thetford, IP24 1AA
Reasons for the Decision: The Panel took due notice of the Licensing Act 2003, and the Regulations made under it, in particular sections 37 and 42 of the Licensing Act 2003, the guidance issued under section 182 including paragraphs 8.101 and 4.39 and Breckland District Council’s Statement of Licensing Policy.
Objections to the Applicant’s application were received from Norfolk Police on the basis that to grant the transfer of the Premises Licence and DPS would undermine the crime prevention objective.
The Panel was concerned that the Applicant was not fully aware of the conditions attached to the Premises Licence, particularly that the licence and the DPS has been transferred to him in the interim period upon his application being made. The Panel was not confident that the conditions and licensing objective relating to the prevention of crime and disorder would be adhered to. Both applications were therefore refused.
