The Hearing was conducted in accordance with the procedures as set out in the Agenda.

 

That having considered all the oral and written evidence submitted and having given consideration to the Licensing Act 2003 and its regulations, the national guidance Part 2, paragraphs 2.4, 2.6, 2.32, 2.33 to 2.37, 2.38 and Part 10, paragraphs 10.9, 10.10, 10.11, 10.13, 10.19 and the Council’s licensing policy, Part 3, pages 11, 12 and Part 4, pages 14 and 18, the application be granted for a premises licence for the premises known as Bedingfeld Arms, Oxborough to operate in accordance with the conditions as set out below:

There is a seasonal variation requested for any Bank Holiday or New Year’s Eve when the proposed opening hours will be:

0830 – 0200 (indoors only)

Findings of Fact:

1)                 There were no representations from the Police or other responsible authorities in connection with this application apart from Environmental Health

2)                 The applicants have agreed to conditions as set out on page 28 of the Agenda:

a)      Regulated entertainment shall not be permitted in the garden area of the premises after 10.00pm so as to minimise noise nuisance

b)      Prominent, clear and legible notices shall be displayed at all exits requesting the public to respect the needs of local residents and to leave the premises and the area quietly

c)      To prevent noise or vibration emanating from the premises doors and windows at the premises shall be kept closed during regulated entertainment.

The Sub-Committee amends the 1st condition by adding the words “Regulated entertainment shall not be permitted OUTSIDE the premises after 10.00pm so as to minimise noise nuisance.

The Sub-Committee amends the 3rd condition by adding the words at the end of the paragraph: “Except for access to and egress from the premises”.

3)                 The applicants have agreed to remove the loud speakers from the outside area.

4)                 There is no record of complaints relating to noise or disturbance from the prior use of the premises under the Licensing Acts.  In the circumstances therefore, the Licence is granted, subject to the following conditions:  An additional condition is that no loud speakers are permitted in the outside area covered by this application.

Reasons:

1)     The Sub-Committee has struck a balance between the rights of the residents and the needs of the applicants business.

2)     The conditions imposed on the premises license in the opinion of the Sub-Committee promote the Licensing objectives particularly the prevention of crime and disorder and the prevention of public nuisance.
