Declaration of Interest

The duties to register, disclose and not to participate for the entire consideration of the matter, in respect of any matter which a Member has a disclosable pecuniary interest are set out in Chapter 7 of the Localism Act 2011. Members are also required to withdraw from the meeting room as stated in the Standing Orders of this Council.

Following introductions the Chairman explained the procedures to the Applicant. It was also explained that the reserve member would remain in the room but could not take part in discussion.

Exclusion of Press and Public

RESOLVED that under Section 100(A) (4) of the Local Government Act 1972, the press and the public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraphs 1 and 2 of Schedule 12A to the Act.

Consideration of grant of Hackney Carriage/Private Hire Drivers Licence

The Chairman introduced the Panel members and officers in attendance and explained the procedures.

 

The Licensing Officer presented the report in respect of an application for a Hackney Carriage/Private Hire drivers licence, that application having disclosed certain information which required this to be referred to the Panel.

 

The Applicant gave an explanation of the circumstances surrounding the various matters referred to and the members asked the applicant questions.

 

 

The Applicant and the Licensing Officers left the room whilst the panel made their determination. They were invited back to hear the decision. The Chairman advised that they had taken into account the Applicants honesty on the form and in the hearing. They had concerns but understood the circumstances. They were prepared to issue the full 3 year licence with a reminder being given about certain clauses in the drivers handbook.

 

RESOLVED that:

 

having regard to all the information presented the application for the grant of a Hackney Carriage/Private Hire Drivers Licence in accordance with the Local Government (miscellaneous provisions) Act 1976, the Town and Police Clauses Act 1847 and the current Breckland Council Taxi policy be approved.
