To receive apologies for absence. 

Minutes:

Councillor W Richmond was delayed by traffic and he was not present at the start of the meeting, therefore Councillor Gilbert took his place on the Panel.

Declaration of Interests (Agenda Item 2)

The duties to register, disclose and not to participate for the entire consideration of the matter, in respect of any matter in which a Member has a disclosable pecuniary interest are set out in Chapter 7 of the Localism Act 2011.  Members are also required to withdraw from the meeting room as stated in the Standing Orders of this Council.

Findings of Fact

  • The club has been operating for 50 years
  • Membership is not expected to increase as a result of the Club Premises Certificate
  • Access and parking facilities are adequate
  • Toilet facilities are adequate for the number of people using the premises.
  • Cash and alcohol will not be stored at the premises.
  • It is not anticipated that large amounts of money or alcohol will be involved.

Decision

That having considered all the oral and written evidence submitted and having given consideration to the Licensing Act 2003 and its regulations, the national guidance and the Council’s Licensing Policy, the application be granted for a club premises certificate to allow the sale of alcohol for the premises known as Lyng Village Bowls Club to operate during the hours as stated below and subject to the mandatory conditions drawn from the Licensing Act and the following conditions:

Supply of alcohol

Monday to Friday from 18:00 hrs until 21:00 hrs (1 April to 30 September)

Saturday and Sunday from 14:00 hrs until 20:00 hrs (1 April to 30 September)

Hours premises are open to members and guests

Monday to Friday from 18:00 hrs until 21:00 hrs (1 April to 30 September)

Saturday and Sunday from 14:00 hrs until 20:00 hrs (1 April to 30 September)

 

And an additional condition agreed by the Applicant to display a sign on the door advising that no money or alcohol is stored on the premises overnight.

Reasons for Decision

The Panel took account of the evidence before it, provided with the agenda and the comments of the Licensing Officer.

 

The Panel noted the comments received from the Objectors and took those into account, but concluded that they did not directly relate to the Licensing Objectives and the objections were more concerns about what would happen if the Bowls Committee changed in substance.

 

The Licensing Officer had explained the Review process to the Objectors if this happened.
