The Hearing was conducted in accordance with the procedures as set out in the Agenda.
That having considered all the oral and written evidence submitted and having given consideration to the Licensing Act 2003 and its regulations, the national guidance and the Council’s licensing policy, the application be granted for a premises licence for the premises known as Heritage Spice, The Old Cinema, Exchange Street, Attleborough in the terms applied for and subject to the mandatory conditions drawn from the Licensing Act. The Licence shall be subject to additional conditions to those contained in the operating schedule. Namely, conditions numbered one to five and contained within the representation from Norfolk Constabulary dated 29 August 2012.
Reason for Decision
On the evidence available and subject to the conditions referred to above, the Sub-Committee accepts that the applicant under the Licence will promote the Licensing objectives set out in the Licensing Act 2003.
Reference is made to paragraphs 2.33 and 2.35, paragraphs 8.34 through to 8.37, paragraphs 8.40 and 8.43, paragraphs 9.12 and 9.34 and paragraph 10.8 in the National Guidance and to Breckland Council’s own Policy, Part 3 relating to Operating Schedules and Part 4 relating to the promotion of the Licensing Objectives.
The Sub-Committee expressed grave concern at the lack of a response from the Fire Authority in connection with the lack of a means of escape from fire on the first floor of the building. The fact that the windows cannot be opened increased the concern of the Sub-Committee.
The Sub-Committee is aware that it has no power to impose any term, condition or restriction relating to fire safety as referenced at paragraph 2.23 of the National Guidance.
