The hearing was considered in accordance with the procedures set out in the agenda.

 

Decision

 

Having heard the evidence and read the written representations received the committee has made the following decision.

It made the following findings of fact;

  1. That, at the date of the hearing, there had been no outstanding objections to the application from the responsible authorities, in particular the police.
  2. There have been numerous objections from residents in the immediate vicinity of the premises.
  3. There have been no recorded incidents of noise, disturbance received by the Licensing Authority.

      Notwithstanding the above the Committee was minded that the application should be approved with a number of amendments. Following consideration of the following provisions contained in national guidance, in particular paragraphs 2.4, 2.12, 2.32, 2.36. 8.67, 8.68, 10.19, and Breckland Council Licensing Policy, parts 4, 6 and 8.  

 

Box F – Recorded Music

On any day from 12.00 hrs until 23.00 hrs

Subject to the following conditions

  1. Noise Limiter shall be fitted in any area where recorded music is to be played
  2. Doors and windows shall remain closed at all times during regulated entertainment except for access and egress.
  3. Clear, prominent and legible notices shall be placed at every exit requesting that patrons respect the neighbours and leave the premises quietly.

 

Box M – Supply of Alcohol

Sunday to Thursday 10.00 hrs until 23.00 hrs

Friday and Saturday 10.00hrs until 00.00hrs

On any New Year’s Eve from the end of permitted hours on those days to the start of permitted hours on the following day

 

Box O – Hours Premises are Open to the Public

Sunday to Thursday 10.00hrs to 23.30hrs

Friday to Saturday 10.00 to 00.30hrs

On any New Year’s Eve from the end of permitted hours on those days to the start of permitted hours on the following day

 

The licence holder is reminded of condition 7 of the existing licence relating to access to children under the age of 14.
