The Hearing was conducted in accordance with the procedures as set out in the Agenda.




That having considered all the oral and written evidence submitted and having given consideration to the Licensing Act 2003 and its regulations, the national guidance (in particular paragraphs 4.44 – 4.50) and the Council’s licensing policy, the application for the requirement of a Designated Premises Supervisor in respect of a Premises Licence to be disapplied be granted for the premises known as New Buckenham Village Hall.


Reason for the Decision


The Licensing Sub-Committee makes the following findings of fact:

  1. This is the first application to be considered by Breckland Council in committee under the revised legislation for removal of the Designated Premises Supervisor;
  2. There have been no incidents recorded to Breckland Council officers in the recent past concerning the use of the Village Hall.

As a consequence the Sub-Committee is satisfied that the legal test set out in Section 41(D) (5) of the Act has been met.

The Sub-Committee is satisfied that the current Village Hall Hiring Agreement is robust.

Furthermore the Sub-Committee is not satisfied that exceptional circumstances exist in this particular case to warrant refusal of this application.

The Sub-Committee therefore grants this application in the terms applied for.
