This application had been deferred from two previous Committees meetings on 22nd July 2019 and 30th September 2019 as the applicant had submitted amended plans to address the recommended reasons for refusal. This required re-consultation and re-consideration and thus had to be withdrawn from the Planning Committee.

The application was resolved to be approved by the Planning Committee on 29th October 2018 subject to:

 

1)     Delegated authority being granted to the Executive Director of Place to agree all archaeological issues after the Council had heard back on its consultation, and subject to his absolute assurance that the objection that has been raised concerning access via Old Post Office Street will be dealt with within the submitted plans; and

 

2)     Conditions as listed in the report.

 

The access details for Old Post Office Street took some time to resolve, however, further to the submission of amended plans followed by a neighbour re-consultation a road arrangement had been put forward which had dealt with the concerns raised at the 2018 Committee meeting and which the Highways Authority had found to be acceptable. The most recent plan also included changes to reflect issues raised by neighbours during the consultation, such as re-positioning the road to accommodate large vehicles and minor increases in the lengths of plots 19-23. During the drafting of the Section 106 Agreement it had also become apparent that the incorrect land ownership certificate had been signed and submitted with the application. This had now been rectified and notice served on those respective owners of the site. For these reasons the application had been reported back to Planning Committee.

Members considered the matter and fully explored the details of the application in light of prevailing policies and guidance.

The application was approved by the Planning Committee on 22nd July 2019, subject to conditions and subject to entering into a Section 106 Agreement. Since this decision the red line extent of the site had been amended to include a narrow section to the northern boundary, and consultations have been carried out.

4.     delegated authority being granted to the Executive Director of Place to refuse the application if the S106 Agreement is not signed within 3 months of the date of this Committee meeting; and

5.     an informative to be added to the Decision Notice, in respect of amenity and new development to the north of the application site, that should not impact the amenity of existing properties which will be further considered at the Reserved Matters stage.

·        Condition 4: No loading or tipping processes shall be carried out and no deliveries taken at or dispatched from the site outside the hours of 07.00 18:00 Monday to Friday, and 07.00 13:00 on Saturday nor at any time on Sundays, Bank Holidays or Public Holidays. Notwithstanding this, 24 tips a year but no more than 5 per calendar month outside of the above hours are allowed, a register of tipping activities, including times and dates shall be kept to demonstrate this is being adhered to.

·        Condition 5: all operators vehicles to be equipped with broadband noise reversing alarms;

·        Condition 7:Notwithstanding the details indicated on the submitted drawings within 6 months of the date of the grant of permission for the use hereby approved detailed drawings for the off-site highway improvement works to include 2 no passing bays on C139 Bunwell Road (between the site access and the junction with C140) to achieve a 5.5m carriageway width together with the provision of Give Way markings at the junction of the site access with C139 have been submitted to and approved in writing by the Local Planning Authority; and

3.     additional conditions with regards to construction of the bund within 6 months of the date of the permission and not to allow operation of the concrete crusher on site except for storage, cleaning and maintenance purposes.
